Terms of Service: Top of the Map Managed Presence

I. PROPRIETARY ARCHITECTURE & SERVICE MODALITY

The digital assets, inclusive of the managed web presence and optimized Google Business Profile (GBP) configurations, are provided strictly as a non-transferable, licensed service modality. At no point during the tenure of the subscription shall the Client be deemed the owner of the source code, design elements, or domain infrastructure. The Agency retains absolute and exclusive title to all intellectual property heretofore created or managed within the private hosting environment.

II. PECUNIARY OBLIGATIONS & TERMINATION TRIGGERS

• Initial Consideration: A non-refundable Activation Fee of $99.00 USD is a condition precedent to the commencement of digital provisioning.

• Recurring Remuneration: The Client shall remit a monthly subscription fee of $149.00 USD (or $79.00 USD for basic tiers) every 30 days.

• The 7-Day Forfeiture Mandate: Should the Client fail to remit payment within seven (7) days or less of the due date, all digital services shall be subject to immediate summary suspension.

• Sanitization of Assets: Upon the expiration of said 7-day grace period, the Agency reserves the unilateral right to "strip" the GBP of all professional metadata, telephony numbers, and hyperlinked URLs, reverting the listing to a null, unmanaged state.

• Permanent Deletion: The managed website shall be permanently purged from the Agency’s servers on the seventh day of non-payment with zero liability for data loss.

III. EXCULPATION & LIMITATION OF REMEDY

• Warranty Disclaimer: Services are provided on an "as-is" and "as-available" basis with no express or implied warranties regarding customer acquisition or fiscal gain.

• Force Majeure & Third-Party Volatility: The Agency shall be held harmless for any fluctuations in visibility or profile suspensions initiated by Google’s algorithmic adjustments or internal policy changes.

• Maximum Liability Cap: The Agency’s total aggregate liability for any claim arising hereunder—whether in contract, tort, or otherwise—shall not exceed the total sum of one (1) month’s service fee paid by the Client.

• Indemnification: The Client shall indemnify and hold harmless Tommy Cantu, Lizeth, and Top of the Map from any third-party litigation arising from the Client’s business operations or provided media.

IV. ASSET RECOVERY & BUYOUT COVENANT

• Non-Portability: Website design files are proprietary and non-exportable upon cancellation.

• Domain Redemption: Any request for the transfer of a domain name managed by the Agency requires the execution of a $500.00 USD non-negotiable Buyout Covenant.

PRIVACY & DATA GOVERNANCE POLICY

1. Data Acquisition: The Agency collects specific PII (Personally Identifiable Information) including business nomenclature and telephonic data via 210-454-0325. 2. Scope of Processing: Data is processed solely for the fulfillment of managed service obligations. 3. Non-Disclosure: We do not disseminate client data to third-party marketing entities, notwithstanding essential infrastructure providers. 4. Jurisdiction: This policy and all service agreements are governed by the statutes of the State of Texas.
